1. Scope and Who We Are

This Privacy Policy explains how Haze Fitness, operated by Zeke Hayes ("Haze Fitness," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit www.hazefitness.com, apply for coaching, schedule a call, purchase a digital product, enroll in coaching, communicate with us, or otherwise use our websites, forms, digital products, and services (collectively, the "Services").

This Policy applies to information collected online and offline in connection with the Services. It does not apply to third-party websites, platforms, gyms, payment processors, scheduling providers, or social networks that maintain their own privacy policies.

3. Personal Information We Collect

Identifiers and contact information, such as your name, email address, telephone number, mailing address, account identifiers, and social-media handle.

Application and enrollment information, such as age, time zone, occupation or schedule information, fitness experience, goals, equipment access, availability, reasons for seeking coaching, prior attempts, and readiness to participate.

Fitness, wellness, and potentially sensitive information, such as height, weight, body measurements, progress photos, exercise history, workout logs, step counts, sleep and recovery information, injuries, limitations, symptoms, health conditions, medications you choose to disclose, pregnancy status, dietary preferences, allergies, food logs, calorie and macronutrient targets, and information relevant to safe coaching.

Commercial and transaction information, such as products or services purchased, subscription status, transaction date, amount, refund or cancellation information, and limited payment metadata. Full payment-card details are generally collected and processed by our payment processor rather than stored by us.

Communications and content, such as emails, text messages, direct messages, call notes, check-in responses, survey responses, support requests, testimonials submitted to us, and files or media you provide.

Device, internet, and usage information, such as IP address, browser type, device identifiers, operating system, referring URLs, pages viewed, links clicked, approximate location derived from IP address, dates and times of access, and cookie or similar technology data.

Inferences we create from the information above, such as likely preferences, coaching needs, adherence patterns, progress trends, or service recommendations.

4. Sources of Information

We collect information directly from you; automatically from your browser or device; from service providers that help us operate the Services; from payment, scheduling, communications, e-signature, hosting, analytics, and customer-management platforms; from social networks when you interact with our pages or authorize a connection; and from other people when they purchase a service for you or refer you with your permission.

5. How We Use Personal Information

Provide, administer, personalize, and improve the Services, including creating training or nutrition plans, reviewing check-ins, tracking progress, delivering digital products, scheduling calls, and responding to support requests.

Evaluate applications, determine program fit, identify when professional medical clearance or referral may be appropriate, and protect client safety.

Process transactions, maintain billing records, administer renewals, cancellations, refunds, and conditional guarantee requests, and prevent fraud or payment abuse.

Communicate service-related information, appointment notices, plan updates, account messages, legal notices, and, where permitted, marketing communications.

Operate, secure, troubleshoot, analyze, and improve our website, forms, systems, products, and marketing.

Comply with law, enforce agreements, establish or defend legal claims, respond to lawful requests, and protect the rights, safety, and property of Haze Fitness, clients, and others.

6. Cookies and Similar Technologies

We and our service providers may use cookies, pixels, local storage, SDKs, and similar technologies to keep the website functional, remember preferences, measure usage, prevent fraud, and understand marketing performance. The specific technologies used may change as our website and vendors change.

You can control many cookies through your browser settings. Blocking certain cookies may affect site functionality. Unless we specifically state otherwise in a cookie preference tool, our website may not respond to legacy "Do Not Track" browser signals. We will honor legally required opt-out preference signals, such as Global Privacy Control, when applicable to our practices and required by law.

7. How We Disclose Personal Information

Service providers and contractors that perform services for us, including website hosting, cloud storage, payment processing, scheduling, customer relationship management, email and text communications, e-signatures, analytics, security, accounting, legal, and technical support.

Professional advisers, insurers, auditors, and financing or payment partners as reasonably necessary for business operations, risk management, compliance, or dispute resolution.

Government authorities, courts, law enforcement, or other parties when required by law or reasonably necessary to protect rights, safety, prevent fraud, or enforce our agreements.

A buyer, investor, successor, or other party involved in a merger, financing, reorganization, sale of assets, bankruptcy, or similar business transaction, subject to appropriate confidentiality protections where practicable.

Other parties at your direction or with your consent.

We do not authorize service providers to use client health, fitness, nutrition, or progress information for their own unrelated marketing. We do not publicly post client photos, results, testimonials, or identifying progress information without a separate express media authorization.

8. Sale and Sharing of Personal Information

As of the Effective Date, we do not sell personal information for money and do not knowingly share personal information for cross-context behavioral advertising as those terms are defined by the California Consumer Privacy Act. If our practices change, we will update this Policy and provide any legally required opt-out mechanism before engaging in the new practice.

9. Payment and Scheduling Providers

Payments may be processed by Stripe or another payment provider. Scheduling may be provided through Google Calendar or another scheduling platform. Those providers collect and process information under their own terms and privacy policies. We receive transaction, scheduling, and contact information needed to provide the Services but generally do not receive or store full payment-card numbers.

10. Health Information and HIPAA

Haze Fitness is a fitness and wellness coaching business, not a healthcare provider, health plan, or healthcare clearinghouse. Haze Fitness generally is not a "covered entity" under the Health Insurance Portability and Accountability Act ("HIPAA"), and information you provide to us may not be protected by HIPAA. We nevertheless treat fitness, nutrition, injury, and health-related information as sensitive and limit access to people and vendors who reasonably need it for the Services, safety, operations, or legal compliance.

Do not send Social Security numbers, full medical records, insurance records, or other information we have not requested. For diagnosis, treatment, medical nutrition therapy, rehabilitation, pregnancy care, eating disorders, or management of a medical condition, consult an appropriately licensed healthcare professional.

11. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including providing Services, maintaining business and tax records, documenting informed consent and safety screening, resolving disputes, administering guarantees, enforcing agreements, and complying with law. Retention periods vary by record type. We may retain transaction and contract records longer than routine marketing information. When information is no longer reasonably needed, we may delete, deidentify, or securely dispose of it.

12. Security

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information and the size of our business. No transmission, storage system, or security measure is completely secure, and we cannot guarantee absolute security. You are responsible for using secure devices, protecting account credentials, and avoiding the transmission of sensitive information over unsecured channels.

13. Your Choices and Privacy Rights

You may unsubscribe from marketing emails through the unsubscribe link and may opt out of marketing texts by replying STOP. Service, transaction, safety, legal, and account messages may still be sent when necessary. You may request access, correction, or deletion of personal information by contacting zhazemanagement@gmail.com. We may verify your identity and may deny or limit a request when permitted by law, including where information is needed to complete a transaction, protect safety, prevent fraud, maintain required records, or establish or defend legal claims. Residents of certain U.S. states may have additional rights, such as the right to know, access, correct, delete, obtain a portable copy, opt out of certain sales or targeted advertising, or appeal a denied request. These rights apply only when the relevant law covers our business and the particular information. We will not unlawfully discriminate against you for exercising an applicable privacy right.

14. California Privacy Notice

California law may provide eligible residents rights concerning personal information. The categories of information collected, sources, business purposes, and categories of recipients are described in Sections 3 through 8 above. Fitness, health, nutrition, and certain account information may qualify as sensitive personal information under California law.

Haze Fitness may not currently meet the revenue or data-volume thresholds that make the California Consumer Privacy Act applicable. If the law applies to us, eligible California residents may exercise applicable rights to know, delete, correct, opt out of sale or sharing, limit certain uses of sensitive information, and receive equal service and pricing, subject to statutory exceptions.

15. Children and Minors

The Services are not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If we learn that we collected such information without legally valid parental consent, we will take reasonable steps to delete it.

A person under 18 may not purchase or enroll in coaching without the participation, consent, and signature of a parent or legal guardian. The parent or guardian is responsible for payment, safety disclosures, and supervision appropriate to the minor's age and circumstances.

16. International Users

Haze Fitness is based in the United States. If you access the Services from another country, your information may be transferred to and processed in the United States and other countries where our providers operate. Mandatory local privacy rights remain unaffected. We may decline or condition services in jurisdictions where our program, insurance, payment methods, or legal terms are not suitable.

17. Third-Party Links and Platforms

The Services may link to or embed third-party websites and platforms. We do not control and are not responsible for their privacy, security, content, or practices. Review the privacy terms of each third party before providing information.

18. Changes to This Policy

We may update this Policy to reflect changes in law, technology, vendors, or business practices. We will post the updated version with a new Effective Date. If a change materially affects how we use previously collected information, we will provide additional notice or obtain consent when required by law.
